Heath Injury Law settled a case for a woman following a car crash that resulted in a neck surgery. The case settled shortly before trial after the insurance company had refused to pay more than $200,000.00 for over 18 months.
Initially, attorney Blake Heath made a policy limits demand before filing a lawsuit, and he requested the other driver’s insurance pay for his client’s car. The at-fault driver’s insurance company waited to respond to the demand until the last minute. The day before the demand expired, the insurance company offered $100,000.00, which it claimed were the policy limits. However, it did not make any offer related to the totaled car.
The failure to offer any money on the car resulted in the demand being rejected, so Mr. Heath filed suit. Once suit was filed, the insurance company disclosed that there was an umbrella policy. Mr. Heath made a new demand, but the insurance company refused to pay more than $200,000.00.
The insurance company admitted liability but sought to downplay the client’s injuries. The insurance company took the position that the client had made a complete recovery and any issues she was suffering from were related to pre-existing conditions.
Mr. Heath worked with the client’s treating physician, and he retained a life care planner to explain the client’s future medical needs. Mr. Heath also prepared the case for trial by getting illustrations of the client’s injuries.
Shortly before trial, the insurance company offered $475,000.00 and the case settled.
This case illustrates why it is important to hire an attorney that not only specializes in injury claims but is also willing to prepare your case for trial. By showing he was ready for trial, the insurance company finally paid what it owed.
