Brasington v. Defendant

Case Type

$100,000 – Allied Ins.
$46,500 – Nationwide (underinsurance)

Defendant t-boned the plaintiff going approximately 45 mph. Plaintiff Brasington was transported to the hospital via ambulance. Her neurosurgeon diagnosed her with a herniated disk. After conservative treatment of physical therapy and epidural steroid injections, her surgeon recommended surgery of a decompressive lumbar laminectomy.

This case is a perfect example of case that needed a lawyer to work the case beyond the just initial work up. The first carrier was not willing to settle and suit had to be filed. Additionally, given the possibility of future surgery, suit was also brought against the underinsurance carrier. Digging deep into the medical and the insurance policy allowed us to maximize this claim for our client.
